Rockville Centre Peak Savers Terms and Conditions

These Rockville Centre Peak Savers Program Terms & Conditions govern the Rockville Centre Electric (“UTILITY” herein defined as Rockville Centre Electric) residential and commercial demand response Program (the “UTILITY Program”).  By agreeing to these UTILITY Terms & Conditions, Participant acknowledges that Participant has read, understands, and agrees to these UTILITY Terms & Conditions.

The UTILITY Program may be administered by a third-party administrator (“Program Administrator”).  By agreeing to these UTILITY Terms & Conditions, you are also agreeing to be bound by the terms and policies of the Program Administrator. UTILITY may change its Program Administrator at any time without notice

ELIGIBILITY REQUIREMENTS

  • To be eligible to participate in the UTILITY Program, Participant must (for the duration of the UTILITY Program and at Participant’s sole expense):
  • Be a UTILITY residential or commercial electric service account holder with an active electric utility account.
  • Have an installed, operable WiFi thermostat controlling an air conditioning unit, at your Rockville Centre Electric service address
  • The qualifying thermostat must remain connected to Wi-Fi and participants must maintain internet service.
  • Program Administrator reserves the right to seek further information to verify UTILITY electric account holder eligibility by contacting account holder.
  • Agree to the terms and conditions set forth in this Agreement.
  • If Participant moves to a different residence, the Participant may continue participation in the UTILITY Program if the new residence meets the eligibility requirements. Only one member of a household is eligible to participate as a Participant in the UTILITY Program at a given address.

EVENTS

  • During UTILITY Program events, UTILITY will notify the DERMS Administrator via the Program Administrator to automatically inform Participant’s thermostat of the existence of a demand response event (an “Event”), and may cause the thermostat to change the temperature set-point on that day.
  • Participant authorizes DERMS Administrator to automatically adjust qualifying thermostat(s) at Participant’s service address. Adjustments strategy may vary depending on the thermostat manufacturer and household envelope.
  • UTILITY will not call events on holidays unless it is deemed an electrical grid emergency.
  •  Participant may override any or all events.

INCENTIVES

  •  UTILITY account holders are eligible to earn financial rewards for enrolling and continued enrollment in Rockville Centre Peak Savers.
  • The participation incentive is provided solely by UTILITY.
  •  UTILITY will pay $70 for the first enrolled thermostat and $50 for each additional enrolled thermostat. Participants can expect to receive a  payment between 4-6 weeks from the completion and approval of enrollment.
  • UTILITY will pay a $20 annual incentive to Participants who continue to stay enrolled in the Rockville Centre Peak Savers Program.
  • Incentive payments are paid to UTILITY electric service account holders. Only one member of a household is eligible to receive payment for participating in the Rockville Centre Peak Savers Program
  •  Participants can earn one initial enrollment incentive and one continued enrollment incentive per service address.
  •  UTILITY may offer alternative incentive structures in lieu of the incentives described above.
  •  Program Administrator reserves the right to seek further information to process incentive payment(s) for UTILITY electric account holder.
  • Financial rewards will be provided pursuant to the applicable offer unless the enrollment goals of the UTILITY program have been achieved.
  • In the event that the incentive amount changes during the course of the UTILITY Program, the application postmark date will be used to determine equipment eligibility and incentive amount.
  • Enrollment of additional WiFi thermostat may not result in additional Incentives.

INFORMATION SHARING

Participant agrees that:

  •  Program Administrator or DERMS may send Participant emails, text/SMS and other notifications related to the UTILITY Program, including notifications about enrollment status and UTILITY Program-related adjustments to thermostat settings.
  •  Program Administrator may send Participant emails related to the fulfillment of incentives.
  • Program Administrator may collect Participant’s energy usage information and review and analyze such usage information and electric bill information for purposes of fulfilling their obligations under the UTILITY Program and improving the UTILITY Program. Program Administrator treats all such data in accordance with their respective privacy policies.
  • The UTILITY will share certain information (including, but not limited to, Participant name, email address, service address, UTILITY account number,) with the Program Administrator to verify that Participant is eligible to participate in the UTILITY Program.
  •  If the Program Administrator cannot collect the required information, Participant may not be eligible to participate in the UTILITY Program.
  •  You hereby give Program Administrator permission to utilize the information shared at the time of enrollment in furtherance of and to communicate with you about the UTILITY Program.
  • Thermostat manufacturer may share with the Program Administrator your request to unenroll from the UTILITY Program or your deletion of your account, each of which will automatically result in the termination of your enrollment in the Rockville Centre Peak Savers Program.

TERMINATION / WITHDRAWAL

  •  UTILITY reserves the right to unilaterally remove any Participant from the UTILITY Program for any other reason without liability or penalty.
  • Participant may un-enroll from the UTILITY Program at any time without penalty by contacting info@rvcpeaksavers.com
  • These UTILITY Terms & Conditions may be altered, changed, modified or assigned by UTILITY at any time with or without notice to Participant.
  • Incentives available under the UTILITY Program may be changed, modified, substituted, replaced, ceased, or terminated at any time at UTILITY’s sole discretion with or without notice to Participant.
  • Participant’s continued participation in the UTILITY Program constitutes Participant’s acceptance of any and all such changes, replacements, assignments, or terminations.

DISCLAIMER OF LIABILITY; LIMITATION OF LIABILITY

THE UTILITY PROGRAM IS PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.  PARTICIPANT ASSUMES ALL RISK OF PARTICIPATION IN THE UTILITY PROGRAM.   UTILITY MAKES NO REPRESENTATION OR WARRANTY, AND ASSUMES NO LIABILITY WITH RESPECT TO QUALITY, SAFETY, PERFORMANCE, OR OTHER ASPECT OF ANY DESIGN, SYSTEM PRODUCT OR APPLIANCE INSTALLED PURSUANT TO THE UTILITY PROGRAM, OR ENERGY SAVINGS, AND EXPRESSLY DISCLAIMS ANY SUCH REPRESENTATION, WARRANTY OR LIABILITY.  TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARTICIPANT AGREES TO INDEMNIFY UTILITY, ITS AFFILIATES, SUBSIDIARIES, PARENT COMPANY, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES AGAINST ALL LOSS, DAMAGE, EXPENSE, FEES, COSTS AND LIABILITY ARISING OR RELATED TO ANY ACT, BREACH, DEFAULT OR OMISSION UNDER THESE UTILITY TERMS & CONDITIONS OR IN CONNECTION WITH THE UTILITY PROGRAM.  UTILITY DISCLAIMS ANY AND ALL RESPONSIBILITY FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES ARISING FROM OR IN CONNECTION WITH PARTICIPATION IN THE UTILITY PROGRAM OR ARISING FROM OR IN CONNECTION WITH ANY BREACH OF THESE UTILITY TERMS & CONDITIONS.

The information you have provided as part of this Agreement is truthful and you meet the minimum eligibility requirements. Thermostat manufacture or Program Administrator may terminate this Agreement and not enroll you, or terminate your enrollment, in the Rockville Centre Peak Savers Program if you are not truthful in the information you submit as part of this Agreement, if you do not satisfy eligibility requirements, or for any other reason.
