NV ENERGY CUSTOMER AGREEMENT TERMS AND CONDITIONS FOR CUSTOMER PURCHASED SMART THERMOSTAT AND PARTICIPATION IN THE POWERSHIFT PROGRAM
This NV Energy (“Company”) Customer Participation Agreement (“Agreement”) governs participation in its PowerShift Demand-Response program (“DR Program”) when customers purchase and install their smart thermostat(s) and voluntarily participate in the DR Program.
NV Energy customers are eligible to receive a rebate for the purchase of qualifying smart thermostats when they install them in their home and enroll in the PowerShift DR Program which allows NV Energy to remotely access the thermostats during Community Energy Events.
Community Energy Events (“Events”) are held June through September and during times of peak energy use when temperatures are high. Participating in these Events is voluntary; however, customers are encouraged to participate in them as part of their enrollment in the DR Program. Participation in less than 50% of the Events will result in termination of the enrollment in the DR Program.
The customer agrees to allow NV Energy to remotely adjust the setting of the Thermostat during such Events. The customer can opt out of an Event at their discretion. The customer can opt out of the DR Program by contacting NV Energy; however, this will exclude them from receiving any incentives when they do so.
The customer allows NV Energy to share information about their Thermostat, including energy use information with their Thermostat manufacturer for the purpose of enabling the manufacturer to evaluate and improve its products and services. Such information includes, but is not limited to, energy consumption meter usage data, and rate information. Further, the customer agrees and acknowledges that NV Energy may at time be required to disclose customer energy usage information to representatives of the Public Utilities Commission of Nevada, or other applicable authorities, upon request. The customer acknowledges that NV Energy will maintain the confidentiality of their energy use data and other personal information in accordance with its privacy policies and applicable law.
The customer agrees to allow the Thermostat’s manufacturer to share account information, including, but not limited to customer name, email address, service address, NV Energy account number, Thermostat serial number, activation date, thermostat account status, runtime data, set-points, and related details, with NV Energy to verify that the customer is eligible to participate in the DR Program and to evaluate the comprehensive energy impact of the Thermostat. In addition, if the customer chooses to opt out of the DR Program or delete their thermostat account, the customer’s thermostat manufacturer will share with NV Energy such information, each of which will automatically result in the termination of their enrollment in DR Program and forfeit any applicable incentives offered by NV Energy.
The selection, purchase, installation, operation, removal, repair and use of the Thermostat is the sole responsibility of the customer. NV Energy makes no warranties, expressed or implied, including but not limited to the warranties of merchantability or fitness for a particular purpose, with respect to the Thermostat, the installation thereof, or the use or function of any related products, devices, or equipment. NV Energy does not endorse, qualify, or guarantee the functionality of the Thermostat or the installation of the Thermostat by me or any contractor. By choosing to participate in this DR Program, the customer agrees and acknowledges that they are not obligated to purchase any additional goods or services offered by the Thermostat’s manufacturer or its installer(s).
The customers agrees and acknowledges that NV Energy shall have no liability in connection with installation of the Thermostat(s) or its use thereof, including, without limitation, with respect to property damage, destruction, death or personal injury arising in connection therewith and the NV Energy customers releases the Company from all claims, causes of action, demands, liabilities, costs, and expenses related thereto, including all special, indirect, punitive or consequential damages arising therefrom.
The Thermostat, and other web portals or mobile applications associated with the Thermostat, may show the customer’s estimated electric costs based on approximate usage rates. The customer agrees and acknowledges that this information does not and is not intended to replace any of the customer’s billing information. Exact costs based on actual electricity use and rates will continue to be charged on to the customer’s monthly NV Energy bill. Actual savings may vary and will depend on various factors, including geographic location, weather conditions, equipment functionality, usage rates, and Time-of-Use. Program funds, including any funds used for rebates or incentives, will be allocated on a first-come, first-serve basis until the program ends or funds are no longer available. The DR Program may be terminated by NV Energy or the Public Utilities Commission of Nevada without notice.
Participation is limited to NV Energy customers only.
