Stat Rewards Program Terms and Conditions 

Tara Energy Stat Rewards Program

The Tara Energy LLC (“Tara Energy”) Stat Rewards Program (“Stat Rewards”), powered by Resideo’s Connected Savings, is designed to promote responsible energy usage and help reward customers for curbing their usage during peak demand times.

As a participant in the Tara Energy Stat Rewards program, you acknowledge and agree that your receipt and use of the Honeywell [or Amazon] thermostat (if purchased through Tara Energy or a related subsidiary) and your participation in Stat Rewards are subject to the following terms and conditions.

You are eligible for benefits through Stat Rewards if you meet ALL of the following criteria: 

• Own a Honeywell Home Wi-Fi Focus, Wi-Fi Vision, Wi-Fi 9000, Wi-Fi, Smart Thermostat, Wi-Fi 7-Day Programmable Thermostat, T5, T6, Round Smart, T9, T10, or Amazon Smart Thermostat. 
• Register your smart thermostat with the manufacturer.  
• Have a residence with the registered smart thermostat and active Tara Energy account, with central air conditioning or a heat pump.
• Have an active electricity Smart Meter at the Tara Energy account service address.
• Maintain active status in the Connected Savings platform.
• Agree to the terms and conditions set forth in this agreement

In exchange for any rate discounts or enrollment incentives received at the time of thermostat purchase (including but not limited to, discounted thermostat purchase price), you agree to enroll such thermostat in Stat Rewards, managed by Resideo (“Program Administrator”). You agree to participate in electricity conservation or reduction in response to Stat Rewards events, or for other reasons, as determined by Tara Energy (or Program Administrator) and to allow Program Administrator to remotely adjust your thermostat during your participation in Stat Rewards.

By participating in Stat Rewards, you agree that Tara Energy may share your enrollment and usage information with third parties providing services related to Stat Rewards, including Tara Energy’s Program Administrator, Resideo. By agreeing to these terms and conditions, you also agree to Program Administrator’s EULA and Privacy Policy, available at https://connectedsavings.com/eula and https://connectedsavings.com/privacy-overview/privacy-policy/ (respectively) or such other location as notified by the Program Administrator on its website.

Rewards and Incentives 

Tara Energy may offer incentives for participating in Stat Rewards (“Rewards & Incentives”). Tara Energy may make changes to the Rewards & Incentives from time to time, with or without notice to you, including updating Stat Rewards details on its website. Failure to successfully install and enroll your thermostat with the manufacturer will prevent your participation in Stat Rewards. To continue receiving rewards and incentives, your thermostat must remain actively enrolled in Stat Rewards powered by Connected Savings, your thermostat must have been connected to WiFi within the last 14 days, and you must remain an active Tara Energy customer in good standing.

By agreeing to these terms and conditions, you agree to receive communication from Tara Energy via email and/or phone regarding Stat Rewards enrollment and events. 

Enrollment in the program does not guarantee that you will receive any Rewards & Incentives. Restrictions and limitations may apply.

Your Right to Opt Out 

You always have the ability to opt-out of any particular event by appropriately adjusting the thermostat settings. You may also cancel your Stat Rewards enrollment at any time by calling Tara Energy Customer Care (1-866-587-8674) or emailing your opt out request to energysupport@resideo.com. Please note that opting out will suspend any rate discounts associated with participation in the program.

Our Right to Cancel 

Tara Energy reserves the right to suspend, cancel or modify Stat Rewards, or your participation in such, at any time for any reason. 

Limitation of Liability 

TARA ENERGY AND ITS AFFILIATED ENTITIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, RELIANCE, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO THESE TERMS AND CONDITIONS OR STAT REWARDS OR FOR ANY DAMAGES FOR LOST PROFITS, LOSS OF USE OF STAT REWARDS SERVICES, LOSS OF DATA, LOSS OF PRIVACY OR SECURITY, LOSS OF OTHER INTANGIBLES, OR UNAUTHORIZED ACCESS TO OR USE OF STAT REWARDS SERVICES, YOUR DATA OR USER CONTENT, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER LEGAL THEORY, AND EVEN IF TARA ENERGY IS ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, TARA ENERGY WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND RESULTING FROM YOUR USE OF OR INABILITY TO USE STAT REWARDS. YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE STAT REWARDS IS TO STOP USING STAT REWARDS. THE MAXIMUM AGGREGATE LIABILITY OF TARA ENERGY ARISING OUT OF OR RELATED TO THESE TERMS OR THE STAT REWARDS SERVICES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, SHALL BE THE TOTAL AMOUNT, IF ANY, PAID BY YOU TO TARA ENERGY TO USE THESE SERVICES, OR $100.00, WHICHEVER IS GREATER. ALL DISCLAIMERS, LIMITATIONS, OR EXCLUSIONS OF LIABILITY OF ANY KIND (INCLUDING IN THIS SECTION AND ELSEWHERE IN THIS AGREEMENT) ARE MADE ON BEHALF OF THE AFFILIATED ENTITIES AS WELL AS EACH AFFILIATED ENTITY’S LICENSORS, SUPPLIERS AND SERVICE PROVIDERS. THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY UNDER THIS AGREEMENT WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
